Petitioner in person and with counsel, to-wit: Attorneys
Albert Carricarte,
Miguel Suarez and Herman Cohen present in open court.
Respondent by counsel only, to-wit: Assistant State Attorney
Donald Bierman
present in open court.
Carlos Rodriguez was called, sworn and testified in behalf
of the Petitioner.
Petitioner offered into evidence without objection statement
of interrogation
of Teodosio Bahadue taken February 27, 1967 which was
ordered, received and
marked filed as Petitioner's exhibit #1.
Respondent offered into evidence, out of turn and without
objection, copy
of autopsy findings on the body of Eladio Del Valle and copy
of
certificate of Death
which were ordered, received and marked filed as
Respondent's exhibits A
and B respectively.
David Green was called, sworn and testified in behalf of the
Petitioner.
Earl Richardson was called, sworn and testified in behalf of
the Petitioner.
Petitioner rests.
Respondent rests.
Court heard argument of counsel.
Petitioner offered into evidence without objection, a
statement of Teodosio
Bahadue taken July 15, 1969 which was ordered, received and
marked filed
as Petitioner's exhibit #2.
The court ordered the Defendant released from custody after
posting a $50,000.00
Bond.
Court recessed.
Defendant not being at liberty under bond was remanded into
the custody of
the Sheriff.
