SUBJECT: Possible effect of the expatriation laws on those engaging in revolutionary activities in the Caribbean States.

Reference is made to your letterhead memorandum dated September 11, 1959 and our interim reply December 17, 1959.

The following information concerning loss of citizenship by certain United States nationals has been furnished by the Passport Office of the Department of State.

"Morgan, William Alexander - Born at Cleveland, Ohio April 19, 1928.  Held to have expatriated himself under Section 349(a)(3) of the Immigration and Nationality Act by continuing to serve voluntarily as a Major in the Cuban Revolutionary Army after it became part of the Cuban Armed Forces on January 2, 1959.  Certificate of Loss of Nationality approved September 21, 1959."  (Information concerning the loss of United States nationality by William Alexander Morgan had been previously furnished to your bureau.)

"Hughes, Paul Joseph - Born at Atlanta, Georgia, October 8, 1928.  Held to have expatriated himself under Section 349(a)(3) of the Immigration and Nationality Act by continuing to serve voluntarily on and after January 2, 1959 as a Captain in the Cuban Air Force.  Certificate of Loss of Nationality approved October 2, 1959."

"Marks, Herman Frederick - Born at Milwaukee, Wisconsin, August 1, 1921.  Held to have expatriated himself under

Section 349(a)(3) of the Immigration and Nationality Act by continuing to serve voluntarily on and after January 2, 1959 as a Captain in the Cuban Revolutionary Army.  Certificate of Loss of Nationality approved December 3, 1959.

"Abrante, Jose - Born at Tampa, Florida June 5, 1932.  Held to have expatriated himself under Section 349(a)(3) of the Immigration and Nationality Act by continuing to serve voluntarily on and after January 2, 1959 as Aide to the Chief of the Cuban Revolutionary Army.  Certificates of Loss of Nationality approved December 3, 1959."

The cases of other persons who engaged in revolutionary activities in Cuba are being investigated as the opportunity arises.  Your bureau will be informed regarding such cases whenever a finding of loss of United States nationality is made by the Passport Office.

The latter has informed us that it is not entirely clear to them what foreign states were intended by your bureau to be included in the category of "Caribbean States".  It will be appreciated if you would clarify this point by enumerating these states.  The titles of political and regional groupings used by the Department of State do not always coincide with geographic definitions of the same areas; e.g., the Office of Caribbean and Mexican Affairs deals only with the affairs Cuba, the Dominican Republic, Haiti, and the Republic of Mexico.
